Reasonable expectations of a Costa Rica private  investigation

In any relationship, there are two sides to every story. What should be your expectations of a Costa Rica investigation?  An investigator may consider an absurd request of a client, could stem from from simple lack of communication.  During the process.on giving facts which not only satisfy the case but to satisfy the client may confusing. A private investigators work is in a results-driven market.  It is here  these heightened beliefs which drive some investigators to always bring their respective “A-game” to each assignment. However, this may also lead some investigators to worry in those rare occasions where your results may fall short of your goals, (as well as the client’s interest  future engagements).

Private investigations are not an exact science

As with most who provide services, we do not always have the luxury of hand-selecting our clients.  In some instances we are faced with certain clients who can be more of a burden than a blessing.  Nothing is more frustrating to an investigator than a client who tries and manage an investigation by intruding or withholding information. Costa Rica is a beautiful and generally a safe place to visit. I have prepared a few Costa Rica travel tips from to help you. Planning and travelling to Costa Rica will go smoother. First don’t leave your belongings unguarded. This is especially important when you are on the beach or in a crowded place. Keep your passport, money, and other valuables close at hand. Beware of scams. There are many scams targeting tourists in Costa Rica. Be aware of schemes such as people offering to help you carry your luggage or sell you drugs. Stay alert when driving. Many roads in Costa Rica are narrow and winding, and there is a lot of traffic. Be especially careful when driving at night.

Be aware of your surroundings.

Keep an eye out for pickpockets. Also, be careful when using ATMs. Keep your money in your pockets or inside your backpack. It is common for thieves to target visitors. Know the rules.

How Does Surveillance in Costa Rica Work?

The most important stage of surveillance in Costa Rica is getting to know the “subject” or in many instances, the suspected cheater. So, how does surveillance work in Costa Rica? Information that would be necessary such as knowing the habits of the target. For example what the cheating husband, boyfriend, wife, or girlfriend likes, or dislikes. Other habits, type of food preferred, favorite restaurants frequented, employment information, hobbies, and vehicles are driven.  The possible person he/she might be cheating with, and a description of all parties. Provide information on everything if you suspect your spouse/partner of cheating as, the more you provide upfront, the better the chance for success. Leaving out a detail or two can have a dramatic effect on the outcome of the surveillance.

Once obtained and reviewed “a feel” for the subject and knowing his/her habits, the fieldwork, or surveillance, begins. While some private investigators hold themselves out to be surveillance experts, you know your spouse/partner better than they do. The more information that you can provide them, the better chance for success in the field.

As the surveillance progresses, most clients want regular reports or communication regarding what we are finding in the field. Communication with clients on a continuing basis is an indispensable part of a professional surveillance strategy.

Surveillance in Costa Rica

With most private investigators it is common knowledge that the cheater is, generally, aware that someone may be watching or following him/her. Usually, this makes people become more aware of their surroundings while cheating. At times both the subject and the person who he/she is cheating with are both cheating, thus making it more difficult to follow them without being seen. Circumstances like these can make it more practical to use a second investigator. While this will increase the cost, using two investigators on surveillance diminishes the chance of being burnt during the surveillance or losing the subject in traffic. Most successful surveillance operations involve a two or more-person team. This is especially true in Costa Rica.

There are times when infidelity, or cheating, is just not taking place even though you have seen signs to the contrary. There are also times when the cheating is far too infrequent with no established patterns, or so well hidden, that catching the cheater is not possible using normal investigative techniques.

Confidentiality and Discretion

All surveillance investigations should be completely confidential and private. Your identity, along with all information that we obtain on your behalf, should be maintained in the strictest of confidence. Information that obtained as a result of the surveillance should only be provided to you or your attorney.

If you have surveillance that needs to be conducted in Costa Rica, be sure you vet the Investigator you contact. There are only a few here and caution should be exercised, particularly with people that want you to send money via Western Union. Caution should also be exercised with people who have only been here for the past year or so. Some boast of their background, but few can back it up. Be especially cautious of people who hold themselves out as consultants. The ones I know are retirees and have no real practical experience in private investigation. Just because they worked for the government doesn’t make them good or reliable private investigators.

Do you ever have a gut feeling that you have a cheating girlfriend in Costa Rica? Concluding all of us men are the same. Costa Rica Squatters

Costa Rica Squatters: Just when it seemed that investing in property in Costa Rica was safe, today saw the expropriation of property occupied by Costa Rica squatters. After a lengthy legal 2-year battle, a group of Costa Rican squatters expropriates land from owners. Squatters (“Campesinos”) have managed to take approximately 1050 acres from Dutch investors after a lengthy 2-year court battle.

April 2011 saw 316 families enter the farm in Medio Queso de Los Chiles. Located in Costa Rica’s central Northern Zone, near the border of Nicaragua. I know, the land belongs to a group of  investors, who rented the property to Costa Rica farmers. Consequntly, the land grab continues. If you have property here especially now, and you are an absentee owner beware you are at risk.

What is a squatter?

In the US, a squatter is any person who has moved onto property without permission of the owner. Commonly known as adverse possession.  Similarly, Costa Rica squatters move onto the property. Your intervention can stop the squatters building and protect yourself. I know the land is owned by a group of Dutch investors, who rented the property to a Costa Rican farmer. The farmer has been using the land to grow crops for the past few years, but the investors have decided to sell the land to a new buyer.

The farmer is worried he will lose his land and his livelihood if the new buyer decides to evict him. Shifting buildings and dwellings and claiming the land as their own. The squatters claim the owners were not producing on the land.  This is despite the declaration by the Costa Rican that had leased the land. Subsequently, asserting that he had made over $2 million in improvements to the agriculture area since the time he leased it.

The conflict grew over the next two years,  with the Costa Rica squatters being evicted numerous times by the police.  On several occasions, the attempts to evict the squatters turned violent.  The squatters alleged in addition to destroying their homes on several occasions the owners hired men to destroy farm animals. Moreover the men in doing so their belongings as well.

What happened next?

The squatters frequently returned to the property after being evicted, sometimes within hours of the eviction, and begin rebuilding. The dispute made Costa Rica national headlines last year when a secret audio recording of a police officer instructing privately hired guards to “shoot to kill” was made public.

The government agency that oversees such disputes, known as the Rural Development Institute (INDER) issued resolution 032-2013 this week, which orders the land to be expropriated and given to the squatters.

Over the years, the squatters have drawn support from many Costa Ricans, including on social networks. The local daily, newspapers heralded the decision by INDER to expropriate the property. One paper *Dario” declared,  “This agreement is a triumph for rural families of that community”. “The successful expropriation sets a precedent for struggling “Campesinos” (squatters) of the country. It shows that INDER is legally qualified to expropriate and distribute land to “Campesinos” who need it,” the newspaper continued.

Adverse possession in the US

Unlike the United States which has statutes in all states covering adverse possession, Costa Rica has none. Costa Rica law provides that unimproved agricultural land can be occupied by squatters. Furthermore, once they erect a structure they can obtain title to the land. There is no time restriction, thus the land once occupied by the squatter takes a court action to remove. The United States adverse possession laws give time limits with most requiring seven years of occupancy openly and notoriously prior to the squatter obtaining title.

This decision will have a chilling effect on foreign land investors. Gear said that any investor contemplating investing in unimproved land in Costa Rica should seek the services of a licensed attorney in Costa Rica prior to buying such land.
